Options to Avoid Foreclosure in Delray Beach

Know your Options - With the economy today and the drop in value of your home in the Delray Beach area,Know your options are you worried that you maybe facing a foreclosure with your Delray Beach Home? Before you do or don't do anything, is to educate youself on what are your options to foreclosure. Below you will a brief explanation of what is a foreclosure, short sale, reinstatement, deed in lieu, modification, etc.

 

Reinstatement
A reinstatement is the simplest solution for a foreclosure, however it is often the most difficult. The homeowner simply requests the total amount owed to the mortgage company to date and pays it. This solution does not require the lender's approval and will 'reinstate' a mortgage up to the day before the final foreclosure sale.

Forbearance or Repayment Plan
A forbearance or repayment plan involves the homeowner negotiating with the mortgage company to allow them to repay back payments over a period of time. The homeowner typically makes their current mortgage payment in addition to a portion of the back payments they owe.

Mortgage Modification
A mortgage modification involves the reduction of one of the following: the interest rate on the loan, the principal balance of the loan, the term of the loan, or any combination of these. These typically result in a lower payment to the homeowner and a more affordable mortgage.

Rent the Property
A homeowner who has a mortgage payment low enough that market rent will allow it to be paid, can convert their property to a rental and use the rental income to pay the mortgage.

Deed-in-Lieu of Foreclosure
Also known as a "friendly foreclosure," a deed-in-lieu allows the homeowner to return the property to the lender rather than go through the foreclosure process. Lender approval is required for this option, and the homeowner must also vacate the property.

Bankruptcy
Many have considered and marketed bankruptcy as a "foreclosure solution," but this is only true in some states and situations. If the homeowner has non-mortgage debts that cause a shortfall of paying their mortgage payments and a personal bankruptcy will eliminate these debts, this may be a viable solution.

Refinance
If a homeowner has sufficient equity in their property and their credit is still in good standing, they may be able to refinance their mortgage.

Servicemembers Civil Relief Act (military personnel only)
If a member of the military is experiencing financial distress due to deployment, and that person can show that their debt was entered into prior to deployment, they may qualify for relief under the Servicemembers Civil Relief Act. The American Bar Association has a network of attorneys that will work with servicemembers in relation to qualifying for this relief.

Sell the Property
Homeowners with sufficient equity can list their property with a qualified agent that understands the foreclosure process in their area.

Short Sale
If a homeowner owes more on their property than it is currently worth, then they can hire a qualified real estate agent to market and sell their property through the negotiation of a short sale with their lender. This typically requires the property to be on the market and the homeowner must have a financial hardship to qualify. Hardship can be simply defined as a material change in the financial stability of the homeowner between the date of the home purchase and the date of the short sale negotiation. Acceptable hardships include but are not limited to: mortgage payment increase, job loss, divorce, excessive debt, forced or unplanned relocation, and more.

What is a Short Sale?

A Palm Beach Short Sale occurs anytime the value of the property is less than the amount owed to the lender and the lender agrees to write off the difference. In other words, the homeowner is "upside down" on his loan. Short sales may be forced by a variety of situations: job loss, loss of income, divorce, medical bills, or changing payments on adjustable rate mortgages (ARMs).

Why would a lender agree to a Short Sale? Lenders make their own business judgments when accepting or rejecting short sales. Lenders are in the business of making and servicing loans, not taking properties back through foreclosure and reselling them. They want to avoid spending time and money to foreclose, evict borrowers, and resell properties. They want to avoid paying property taxes, insurance, maintenance and repairs. They want to avoid risking theft and vandalism to the property. Before the mortgage lenders will consider a short sale, they need to know financial information about the seller and why the seller cannot pay the loan. The seller will need to submit information to the lender to assist the lender in deciding whether to accept a short sale.

Foreclosure Solutions - Avoiding Foreclosure

The current U.S. housing market and national financial crisis has caused untold stress and heartache for many American families. Foreclosure is one of the most devastating financial challenges that a family can face and one that many times can be avoided. The options available to Boca Raton-area residents for foreclosure are many. Following is a brief explanation of these solutions, including their benefits and drawbacks:

 

Reinstatement 

A reinstatement is the simplest solution for a foreclosure, however it is often the most difficult. The homeowner simply requests the total amount owed to the mortgage company to date and pays it. This solution does not require the lender's approval and will 'reinstate' a mortgage up to the day before the final foreclosure sale.

 ·  Benefit: Does not require the mortgage company or lender's approval.

·   Drawback: Requires that a homeowner be able to pay all back payments, fines and fees.

 

Forbearance or Repayment Plan

A forbearance or repayment plan involves the homeowner negotiating with the mortgage company to allow them to repay back payments over a period of time. The homeowner typically makes their current mortgage payment in addition to a portion of the back payments they owe.

·   Benefit: Allows the homeowner to make back payments over time.

·   Drawback: Requires that a homeowner be in a financial position to pay not only their current mortgage, but also a portion of the back payments owed. Some mortgage companies will require a homeowner to 'qualify' for forbearance.

 

Mortgage Modification

A mortgage modification involves the reduction of one of the following: the interest rate on the loan, the principal balance of the loan, the term of the loan, or any combination of these. These typically result in a lower payment to the homeowner and a more affordable mortgage.

·   Benefit: Reduces the payment a homeowner is required to make on a monthly basis and may reduce the principal balance of the loan

·   Drawback: Requires that a homeowner 'qualify' for the new payment and will often require full documentation. Lender has to be actively pursuing modifications.

 

Rent the Property 

A homeowner who has a mortgage payment low enough that market rent will allow it to be paid, is able to convert their property to a rental and use the rental income to pay the mortgage.

·   Benefit: Allows homeowner to keep property indefinitely.

·   Drawback: The issues that can arise with a rental property are many, and rent often does not cover the full cost of property ownership and maintenance.

 

Deed in Lieu of Foreclosure

Also known as a 'friendly foreclosure', a deed in lieu allows the homeowner to return the property to the lender rather than go through the foreclosure process. Lender approval is required for this option, and the homeowner must also vacate the property.

·   Benefit: Many times in a successful deed in lieu, the lender will forego their right to a deficiency judgment.

·   Drawback: Requires that a homeowner vacate the property, and a deed in lieu may be reported to credit bureaus as a foreclosure.

 

Bankruptcy 

Many have considered and marketed bankruptcy as a 'foreclosure solution,' but this is only true in some states and situations. If the homeowner has non-mortgage debts that cause a shortfall of paying their mortgage payments and a personal bankruptcy will eliminate these debts, this may be a viable solution.

·   Benefit: Does not require lender approval.

·   Drawback: If a homeowner cannot afford their mortgage payment, a bankruptcy will only stall—not stop—the foreclosure process. Bankruptcy can be costly, is damaging to credit scores, and can only be declared once every seven years.

 

Refinance 

If a homeowner has sufficient equity in their property and their credit is still in good standing, they may be able to refinance their mortgage.

·   Benefit: In some cases, this will lower payments.

·   Drawback: In today's market, a refinance will almost always raise mortgage payments, and is an expensive process.

·   Drawback: In many cases today, homeowners do not have sufficient equity to sell their property without negotiating a short sale (see next solution).

If a homeowner owes more on their property than it is currently worth, then they can hire a qualified real estate agent to market and sell their property through the negotiation of a short sale with their lender. This typically requires the property to be on the market and the homeowner must have a financial hardship to qualify. Borrower may qualify for another mortgage in as little as 24 months (as opposed to five years for a foreclosure).

·   Drawback: Short sales can be a trying process in which a homeowner is best served by contracting with a qualified real estate agent to guide the way.

Mr. Homebuyer, Here's Why I Didn't Send That One

Today I read a great post by Maggie Dokic a Realtor in the Palmetto Bay & Redland area of Miami.  While she is refers to the Miami Real Estate market, this is very true to any real estate market today, including the Boca Raton / Delray Beach area. I hope that this will help out any buyer or renter looking in the Delray Beach Boca Raton Real Estate market area to understand & appreciate why Realtors do not send out every home or condo available on the MLS. searching for Miami homesLike most agents in the Miami real estate market, I have quite a number of buyers I am working with.  Several months ago I started making sure that I always meet with each one before we start working together to make sure they understand the process.  We also make sure they're qualified and that we're a good "fit" for one another.  

Even so, I occasionally end up with the very eager buyer who thinks he can help me out by riding around his preferred neighborhoods and call me with addresses to look up for him.  

Inevitably, there is always a reason why I haven't sent him this particular home to review online.  It's not because I missed it.  I want to sell him a house as much as he wants to buy one.  Really!  

If you are working with a real estate agent who is looking for homes for you, here is a list of possible reasons a home may not be suitable for you and won't make it to the emails we send you:  

 

  • The property is priced over your range - in every neighborhood there are homes priced well above what their market value is.  Homes priced over your maximum don't get sent to you.  If your max is $450K, a house that is listed at $575K is not going to be sent to you for review.
  • The property is not listed -  this includes homes you may see that look vacant and may even have a lockbox on the door.  A foreclosure can take a long time to prepare to list.  The listing agent will get it listed as soon as it is possible to do so.  Sometimes it has issues with the title that need to be cleared up. If it is not in the MLS and there is a lockbox on the door, there is no way to know who is going to have it listed.  We simply have to wait until it is.  The good news is that the automatic search that is set up for you will pick it up immediately once it's listed.  Lucky you.
  • The property is a short sale that has not been approved - and you specifically let me know that you don't want to waste your time on unapproved short sales.  Only approved short sales are being sent your way.
  • The property needs extensive repairs - and you are buying with an FHA loan.  Yes, there is an FHA loan that takes repairs into account.  It's called an FHA 203K loan.  But if you're approved for $100K FHA, the house is listed for $100K and needs $25K in repairs, there's no point in looking at that house.  You are not qualified for $125K (the amount of the loan including the repairs).  So this particular house will be filtered out by your agent when she reviews homes to show you.
  • The seller has specified CASH offers only - Sellers usually do this because of the condition.  This is usually seen with bank-owned homes.  It's not that they want to arbitrarily exclude a huge portion of buyers.  They're just being realistic when they say that the house won't qualify for financing.  It may need repairs well beyond the limit on an FHA 203K.  Or the seller may simply want a quick sale due to the horrible conditions of the house.  If it's priced incredibly low, there's always a reason.
  •  The house is pending sale - this means the seller has accepted an offer.  The sign will stay in front of the house until the property closes.  But they have changed the status to Pending Sale in the MLS and they are no longer looking for offers on this one.

The above is not meant to be an exhaustive list.  There may very well be other reasons why a home isn't sent to you for your review.   

But please do know that I am working really hard to find you one that you can call home.
